Terms of use

These Terms of Use constitute a binding agreement between you and Itqan governing your access to and use of our website and services. By creating an account, or by otherwise accessing the service, you agree to be bound by these Terms. If you do not accept them, you must not use the service.

1. The agreement and its scope

These Terms, together with our Privacy Policy, comprise the entire agreement between you and Itqan in respect of the service and supersede any prior understanding relating to its subject matter. In these Terms, references to Itqan, we and us are references to the operator of the service, and references to you are references to the person accessing it.

The service comprises a career navigation platform through which you may assess your professional standing, identify target roles, obtain recommendations for training and certification, and review employment opportunities published by third parties.

2. Eligibility

You may use the service only if you have attained the age of eighteen years and are capable of entering into a binding contract. You warrant that the information you supply upon registration is accurate and complete and that you will maintain it as such.

An account is personal to the holder. You may not permit another person to use your account, and you may not establish an account on behalf of another person without that person's knowledge and authority.

3. Your account and its security

You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account, whether or not authorised by you. You must select a password which you do not use in connection with any other service, and you must notify us without delay upon becoming aware of any unauthorised access.

We may require verification of your email address before some or all of the service is made available to you.

4. Nature of the service

The service provides information, assessment and recommendations. It does not constitute an offer of employment, a representation as to the availability of any position, or advice of a professional, legal or immigration character.

Itqan is not an employer, a recruitment agency or an employment intermediary, and does not act as your agent. We do not submit applications on your behalf, we are not party to any relationship between you and any employer, and we exercise no control over the conduct of any employer or training provider whose material is presented through the service.

We give no undertaking that use of the service will result in employment, in an interview, in a response to any application, or in any other outcome. Information concerning visas, sponsorship or entitlement to work is derived from the sources to which we link and must be verified by you with the competent authority.

5. Automated output and your obligation to verify

Material parts of the service are produced by automated systems, including the reading of submitted documents, the derivation of your professional record, the matching of roles and the compilation of recommendations. Such systems are not free from error, and an error arising at an early stage may affect subsequent stages.

You acknowledge that the confirmation stage presented following extraction forms part of the service and that you are responsible for reviewing and correcting the derived record at that stage. You further acknowledge that you must verify any information before acting upon it, and in particular that you must confirm the terms of any position with the employer concerned and the terms of any course with the provider concerned before incurring expenditure or committing time.

6. Your content

You retain all rights in the documents and other material you submit to the service. Nothing in these Terms operates to transfer ownership of that material to us.

You grant us a non-exclusive, royalty-free licence to store, reproduce, process and analyse the material you submit, for the sole purpose of providing the service to you and for the duration of your account. You warrant that you are entitled to submit the material and that its submission infringes no right of any other person.

Output generated for you, including your derived professional record, your recommended pathway and your matches, is yours to use. The service itself, together with its software, design, structure and underlying systems, remains our property and no right in it is granted to you other than the limited right of use conferred by these Terms.

7. Acceptable use

You must not submit any document belonging to another person, nor represent as your own any qualification or experience which is not. You must not attempt to obtain access to any account or data other than your own, nor attempt to circumvent the limits applicable to your subscription or to obtain material which your subscription does not include.

You must not extract, reproduce, resell or redistribute the employment or training data presented through the service, whether by automated means or otherwise. You must not use the service in contravention of any applicable law, for the harassment of any person, or for the transmission of malicious code, and you must not take any step which impairs or is intended to impair the operation of the service or the infrastructure upon which it depends.

8. Subscriptions and charges

The service is offered on a free plan and on a paid plan. The free plan includes an assessment of your professional standing, your recommended pathway, access to the assistant, and your three strongest employment matches maintained on a current basis, together with one document reassessment each week and thirty messages each day. The paid plan includes all available matches, three document reassessments each week and ninety messages each day.

The paid plan is charged at 2.9 Omani Rials per month. As the payment facility available to us does not support settlement in Omani Rials, the corresponding amount is charged in United States Dollars at 7.54.

We may vary the composition of either plan or the charges applicable to it. Where we do so, we will give you notice before the variation takes effect, and you may cancel in accordance with clause 9.

9. Payment, renewal and cancellation

Charges are collected by our payment processor. We do not receive or retain your payment card details at any time.

A paid subscription renews automatically at the end of each monthly period until cancelled. You may cancel at any time, whereupon your access to the paid plan continues until the expiry of the period for which payment has been made and the account thereafter reverts to the free plan. No content is deleted upon reversion.

Charges paid in respect of a period which has commenced are not refundable, save where a refund is required by applicable law. You are responsible for any charge levied by your bank or card issuer in respect of currency conversion.

10. Availability and variation of the service

We will use reasonable endeavours to maintain the availability of the service, but we do not undertake that it will be available without interruption or free from fault. We may modify, suspend or discontinue any part of the service, and where such a change is material and affects you we will give notice of it.

Parts of the service depend upon facilities provided by others, and an interruption affecting those facilities may affect the service.

11. Suspension and termination

You may cease to use the service at any time and may request the erasure of your account in accordance with our Privacy Policy.

We may suspend or terminate your access where you are in breach of clause 7, where your use of the service is unlawful, or where your use places the service or other users at risk. Where it is reasonable in the circumstances to do so, we will give you notice and an opportunity to remedy the breach before taking such action.

Clauses 4, 5, 6, 12, 13, 14, 17 and 18 survive termination of this agreement, together with any other provision which by its nature is intended to survive.

12. Disclaimer

The service is provided on an as is and as available basis. To the fullest extent permitted by applicable law, we exclude all warranties, conditions and representations, whether express or implied, including any implied warranty of satisfactory quality, fitness for a particular purpose or non-infringement, and any warranty that the service will be uninterrupted, secure or free from error, or that its output will be accurate, current or complete.

We give no warranty as to the accuracy, currency or availability of any employment opportunity, course, certification, price or other material published by a third party and presented through the service. We identify the source of such material and the date upon which it was obtained in order that you may verify it.

Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited.

13. Limitation of liability

To the fullest extent permitted by applicable law, we shall not be liable for any loss of income, loss of profit, loss of opportunity, loss of any offer of employment, expenditure incurred in respect of any course or application, loss of data, or any indirect or consequential loss, howsoever arising.

Our aggregate liability to you in respect of all claims arising in any period of twelve months, whether in contract, in tort or otherwise, shall not exceed the greater of the total amount paid by you to us during that period and 10 Omani Rials.

This clause does not limit liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be limited.

14. Indemnity

You shall indemnify us against any claim, demand, loss, damage, cost or expense, including reasonable legal costs, arising out of or in connection with your submission of material which you were not entitled to submit, your use of the service in breach of clause 7, or your breach of any applicable law.

15. Third party material

The service presents and links to employment opportunities, courses and certifications published by others. We do not control such material, we do not endorse it, and we accept no responsibility for it.

Where you follow a link from the service you leave it, and your use of the destination is governed by the terms and privacy practices of the party operating it and not by these Terms.

16. Force majeure

We shall not be liable for any failure or delay in the performance of our obligations arising from any cause beyond our reasonable control, including any act of God, armed conflict, civil disturbance, act of a public authority, failure of telecommunications or of a utility, or failure of any facility provided by a third party.

17. Variation of these Terms

We may vary these Terms from time to time. Where a variation is material we will give notice before it takes effect, and your continued use of the service after that date constitutes acceptance of the Terms as varied. If you do not accept the varied Terms, you must cease to use the service and may request the erasure of your account.

18. Governing law, jurisdiction and general

These Terms are governed by the laws of the Sultanate of Oman, and the courts of the Sultanate of Oman shall have exclusive jurisdiction in respect of any dispute arising out of or in connection with them.

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force. No failure or delay on our part in exercising any right constitutes a waiver of that right. You may not assign your rights under these Terms; we may assign ours upon notice to you.
